This is the privacy statement of Naktuinbouw. It explains how we handle your personal data. We respect your privacy. This statement clarifies which personal data we collect and the purposes it is used for. We ensure any personal data that you disclose to us is always handled confidentially.

Personal data that we process

Naktuinbouw processes your personal data as you use our (statutory) services and/or because you have provided us with your personal data.
The personal data we process is shown below:

  • Form of address (mr, mrs, X)
  • Address
  • Telephone number
  • E-mail address
  • Location data
  • Bank account number
  • Chamber of Commerce number
  • VAT number
  • Log in details myNaktuinbouw

If you register to attend a training course, we also collect the following personal data:

  • Position
  • Previous education/training

If you apply for a job at Naktuinbouw, we also collect the following personal data:

  • CV
  • Letter of motivation

Why do we process your personal data?

We process the data above for one or more of the following purposes (partly depending on which service or functionality you use) to:

  • process your payment
  • send you our newsletter (by email) and/or magazine Buitenstebinnen (by post of e-mail)
  • contact you by telephone or eemail if this is necessary to perform our services
  • inform you about changes to our services and products
  • answer your questions or handle your complaints via social media, e-mail, by post or by telephone
  • send you an SMS if there is a malfunction in e-CertNL (if you have provided your +31 mobile number for this)
  • allow you to create an account in the myNaktuinbouw portal
  • grant you access to the Naktuinbouw Academy to provide training information and a digital certificate or proof of participation
  • send you a certificate or certificate of participation after a training session
  • inform you about your job application

Automated individual decision-making

We do not make decisions based on automated processing if they concern matters that can have (significant) consequences for natural persons. These are decisions taken by computer programs or systems, without the intervention of a natural person (e.g. a Naktuinbouw employee).

Data retention

We do not store personal data longer than is necessary for the purpose of data processing or that required under the Dutch Public Records Act.

Sharing personal data with third parties

Naktuinbouw does not sell your data to third parties and only discloses it to third parties if this is necessary for the performance of our agreement with you or to comply with a legal obligation. For example, the Netherlands Food and Consumer Product Safety Authority (NVWA) may request your data from us in the context of research or a report. We conclude a processor agreement with companies that process your data on our instructions to ensure the same level of security and confidentiality of your data. Naktuinbouw remains responsible for this processing.

Right to access, change or delete data

You have the right to access, correct or delete your personal data. In addition, you have the right to withdraw your consent to data processing and to object to the processing of your personal data by Naktuinbouw and you have the right to data portability. This means that you can submit a request to us to send the personal data that we hold about you in a computer file to you or another organisation specified by you.

You can submit a request for access, correction, deletion, data transfer of your personal data or submit a request withdrawing your consent or objecting to the processing of your personal data by e-mail.

To ensure that the request for access to this data has been submitted by you, we kindly ask you to send a copy of your identity document with the request. To protect your privacy, black out your passport photo, MRZ (machine-readable zone, the strip with numbers at the bottom of the passport), passport number and citizen service number (BSN) in this copy. We will respond as quickly as possible, but no later than within four weeks, to your request.

Naktuinbouw would like to inform you of your right to file a complaint with the national supervisory authority, the Dutch Data Protection Authority.

How we protect personal data

Naktuinbouw takes the protection of your personal data seriously and takes appropriate measures to prevent misuse, loss, unauthorised access, unwanted disclosure and unauthorised modification. If you are under the impression that your personal data is not properly protected or there are indications of data abuse, please contact us via e-mail.

We take the greatest of care to ensure the content of this site and myNaktuinbouw is as complete, correct, up to date and as accessible as possible. We are not liable or responsible for damage that comes from the information provided by Naktuinbouw or provided by third parties, nor for the inaccessibility or unavailability of this information. This includes – but is not limited to – the violation of Plant Breeders’ Rights, work(s) patented or protected by copyright or violating the intellectual property rights of third parties in any other way.

All copyrights and other intellectual property rights on all texts, images and software on this website and myNaktuinbouw, are the property of Naktuinbouw and/or the holders how have granted a licence to Naktuinbouw. This means that the it is not permitted to publish, reproduce, and/or amend any part of the information contained on this website, without the express, written permission of Naktuinbouw, unless it is for private use. No reproduction whatsoever of any part of this site may be sold or distributed for commercial purposes or be amended or incorporated into any other work or publication, whether in the form of a hard copy or in electronic form, including the sending of such to another site, incorporation of such in another site (framing) or by linking from other sites to this site, unless we have granted prior permission. The use of any marks depicted on this site is forbidden, unless we have granted prior, written permission.

<i>my</i>Naktuinbouw

myNaktuinbouw is an extra service for companies registered with Naktuinbouw. The term of storage of the data contained in this portal shall not exceed two years. An exception to this are requests for laboratory tests, which we keep for five years. After the period of two or five years, the data will no longer be displayed and will not be retrievable in the form of hard copy from Naktuinbouw either. For variety registration and Plant Breeders’ Rights testing, we will solely show the results of tests. No rights can be derived: the authority to grant Plant Breeders’ Rights rests with the Board for Plant Varieties.

Login myNaktuinbouw

A user of myNaktuinbouw is obliged (on request of Naktuinbouw) to provide Naktuinbouw with all essential information regarding the login. The user guarantees that all the information submitted is complete and correct and must ensure that any amendments made to this information are communicated immediately to Naktuinbouw. The user is responsible for ensuring that his/her login will only be used for personal use. The login data provided is intended solely for personal use by the user and may not be disclosed to third parties without the express, written permission of the provider. The user is obliged to solely use the login for the purpose for which it was provided to the user. We cannot be held liable for the login data managed by the user.

Cookies

Naktuinbouw only uses technical and functional cookies. A cookie is a simple, small file that is sent when you visit the website for the first time and stored by your browser on the hard disk of your computer, your tablet or smartphone. The cookies we use are necessary for the proper technical performance of the website to guarantee a user-friendly visit. They ensure that the website functions properly. You can refuse cookies by setting your internet browser so that it does not store cookies anymore. In addition, you can also delete all information previously saved via the settings of your browser.

This site provides access to texts from Dutch and European laws and legislation that relate to the field of activity of Naktuinbouw. The publication of these texts by means of the Naktuinbouw website does not constitute publication in the sense of the Dutch Constitution and/or the Dutch General Administrative Law Act. Only national legislation published by the Government (including the Ministry of Agriculture, Fisheries, Food Security and Nature) in the Bulletin of Acts and Decrees or the Government Gazette has an official nature. With regard to the stated European legislation, the text as published in the ‘Official Journal of the European Union’ (L-series, ISSN 1725-2598) is decisive. Naktuinbouw does publish the Testing Regulations as referred to in Article 20 of the Seeds and Planting Materials Act 2005.

We reserve the right to change this privacy statement from time to time. Any changes will be published on this website. We never use your data without consent for purposes other than those for which you provided the data.
